TAKE NOTICE that the Council of the Corporation of the City of Orillia passed By-law 2025-018 on the 3rd day of March, 2025 under Section 34 of the Planning Act, R.S.O. 1990, Chapter P. 13, as amended.
AND TAKE NOTICE THAT no persons or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a Public Meeting or written submissions to the Council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
AND TAKE NOTICE THAT an appeal to the Ontario Land Tribunal in respect to all or part of this Zoning By-law Amendment may be made by filing a Notice of Appeal with the City Clerk either via the Ontario Land Tribunal e-file service (first-time users will need to register for a My Ontario Account) at https://olt.gov.on.ca/e-file-service/ by selecting City of Orillia as the Approval Authority or by mail to 50 Andrew Street South, Suite 300, Orillia, ON, L3V 7T5 no later than 4:30 p.m. on Wednesday, April 2, 2025. The filing of an appeal after 4:30 p.m., in person or electronically, will be deemed to have been received the next business day. The appeal fee of $1,100.00 can be paid online through e-file or by certified cheque/money order to the Minister of Finance, Province of Ontario. If you wish to appeal to the Ontario Land Tribunal (OLT) or request a fee reduction for an appeal, forms are available from the OLT website at www.olt.gov.on.ca. If the e-file portal is down, you can submit your appeal to planning@orillia.ca. There is also an administrative fee payable to the City of Orillia by cash, debit or cheque in the amount of $10,000 for any appeal filed regarding an Official Plan Amendment.
An explanation of the purpose and effect of the by-law, describing the lands to which the by-law applies, and an explanation of the effect written and oral submissions had on the decision is outlined below. The complete by-law is available for inspection in the Clerk’s office during regular office hours.

EXPLANATION - By-law 2025-018 (67 Colborne Street West, 76 Victoria Street, and Roll No. 4352 020 201 11100 – Joe Trombly Automotive Services Ltd.)
Description of the Land:
The subject lands are known municipally as 67 Colborne Street West, 76 Victoria Street, and Roll No. 4352 020 201 11100 and are located on the south side of Colborne Street West between Albert Street South and Wyandotte Street.
Purpose and Effect of the Proposed Zoning By-law Amendment:

The purpose of this concurrent Official Plan Amendment and Zoning By-law Amendment is to permit the subject lands to construct a 6-storey, Mixed Use Building with one commercial unit and 31 dwelling units, together with various site-specific exceptions related to setbacks, buffer widths, lot coverage, and allowing off-site snow storage and bicycle parking. By-laws 2025-018 and 2025-019 amends the City’s Official Plan and Zoning By-law 2014-44, as amended, to achieve that purpose.
Effect of Public Input:
Council had regard for all public input received through written and/or verbal submissions prior to the conclusion of the Public Meeting held on February 10, 2025.
