TAKE NOTICE that two (2) applications have been received from Huronia Wholesale Limited (Agent: William McLean) for proposed Zoning By-law Amendments (File Nos. D14-808 & D14-809) pursuant to the provisions of the Planning Act, as outlined below.

AND TAKE NOTICE that the Council of the Corporation of the City of Orillia will hold a consolidated Public Meeting on Monday, June 2nd, 2014, at 6:00 p.m., in the Council Chambers, Orillia City Centre, 50 Andrew Street South, to consider the applications by Huronia Wholesale Limited pursuant to the provisions of the Planning Act as follows:

Description of the Lands:

The subject properties are located on the west side of West Street South, between James Street and the Highway 12 By-Pass. The property subject to Application D14-808 is known municipally as 525 West Street South, and the property subject to Application D14-809 does not have Lot Frontage on a public road and, thus, does not yet have a municipal address.

The subject properties are both designated “Employment Lands – Light Industrial Services” in the City’s Official Plan. The subject properties are both currently zoned “Restricted Industrial” (M2) under Zoning By-law 2005-72, as amended.

Purposes and Effects of the Proposed Zoning By-law Amendments:

Re: Zoning By-law Amendment Application No. D14-808 (“Property 1”)
(525 West Street South)

Re: Zoning By-law Amendment Application No. D14-809 (“Property 2”)
(no municipal address yet assigned)

This application proposes to rezone the property to “Restricted Industrial Exception” (M2-#) to increase the minimum required interior side yard setback to the northerly interior side lot line, from 3.0 metres to 15.0 metres, and to prohibit the use of the northerly-most 9.0 metres for any purpose other than vehicular ingress and egress. This application proposes to rezone the property to “Restricted Industrial Exception” (M2-#) to define its northeasterly lot line as the “Front Lot Line”, and to enable its development in the absence of Lot Frontage or an existing private right-of-way registered on title when Zoning By-law 2005-72, as amended, came into effect.

Related Applications:

Consent Application B11/13 (under Section 53 of the Planning Act) has also been received with respect to the proposed use and development of the lands subject to applications D14-808 and D14-809. The Committee of Adjustment granted provisional consent to that application on December 13th, 2013, which proposed to permit an easement over the lands known municipally as 525 West Street South (“PROPERTY 1”), in favour of a property to its immediate west that does not have any Lot Frontage or municipal address (“PROPERTY 2”). Such an easement would provide continued access to PROPERTY 2 over PROPERTY 1, and facilitate its future use and development.

Oral and Written Submissions – Appeal:

If a person or public body does not make oral submissions at a Public Meeting or does not make a written submission to the Council of the Corporation of the City of Orillia before the proposed Zoning By-law Amendments are passed, the person or public body is not entitled to appeal the decision of the Council of the Corporation of the City of Orillia to the Ontario Municipal Board.

If a person or public body does not make oral submissions at a Public Meeting, or does not make a written submission to the Council of the Corporation of the City of Orillia before the proposed Zoning By-law Amendments are passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

Individuals who make written submissions should be aware that their submission and any personal information in their correspondence will become part of the public record and made available to the Applicant, Committee and Council.
